According to the new General Data Protection Regulation (GDPR), the protection of natural persons in relation to the processing of personal data is a fundamental right and the principles of, and rules on the protection of natural persons with regard to the processing of their personal data should, whatever their nationality or residence, respect their fundamental rights and freedoms, in particular their right to data protection.

In order for processing to be lawful, personal data should be processed on the basis of the consent of the data subject concerned or some other legitimate basis, laid down by law.

The GDPR strengthens both the rights of the data subjects and the obligations of the data controllers. Furthermore, the GDPR introduces new rights such as the right to erasure personal data, the right to data portability, new principles such as the principles of data protection by design and data protection by default. It also introduces new obligations such as the obligation for the data controller to in the case of a personal data breach, to notify the personal data breach to the supervisory authority without undue delay and, where feasible, not later than 72 hours after having become aware of it.
